Common Punishments for a Felony
Most felonies are punishable by a minimum of 16 months in county jail. Until recently you could go to state prison for a felony committed in California. However in 2011, AB109, California’s Realignment Law, went into effect and now most felons are housed in local county jails instead of state prison, with a some exceptions.
Serious and Violent felonies also known as strikes under the California Three Strikes Law are punishable by a minimum of 16 months in county jail or state prison. The punishment varies based on the type of offense, and can involve many years in state prison.
